Important: JobLens is currently in beta. Features, functionality, and terms may change. By using the service, you acknowledge and accept the beta nature of the platform.

1. Acceptance of Terms

By accessing and using JobLens.io ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. JobLens.io reserves the right to modify these Terms at any time. Your continued use of the Service following notification of changes constitutes your acceptance of the updated Terms.

2. Service Description

What JobLens Is

JobLens is a Software-as-a-Service (SaaS) platform designed for moving and relocation professionals to create visual estimates, manage inventory, and document properties using video and image capture. The Service provides tools for estimate generation, client management, and data organization.

Beta Status

JobLens is provided as a beta product. We are continuously developing, updating, and improving the platform. Features may be added, modified, or removed. While we strive to maintain service availability and data integrity, we cannot guarantee uninterrupted service during the beta phase. We appreciate your patience and feedback as we enhance the platform.

3. User Accounts and Responsibilities

Account Creation

To use JobLens, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account.

User Eligibility

  • You must be at least 18 years old or the age of majority in your jurisdiction
  • You must have the legal authority to enter into this agreement
  • You must use the Service in compliance with all applicable laws

Your Responsibilities

  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Ensure all information provided is accurate and current
  • Comply with all applicable terms and laws
  • Be responsible for all activities under your account

4. Acceptable Use Policy

You agree not to use JobLens for any unlawful, harmful, or abusive purposes. Specifically, you may not:

  • Use the Service for any illegal purposes or in violation of any laws or regulations
  • Harass, threaten, defame, or abuse others through the Service
  • Upload or share inappropriate, offensive, or explicit content
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Upload malware, viruses, or malicious code
  • Reverse engineer, decompile, or attempt to discover the source code
  • Spam or send unsolicited communications
  • Violate others' intellectual property rights
  • Collect personal information about others without consent
  • Share pornographic or explicitly sexual content

We reserve the right to investigate violations and take appropriate action, including account suspension or termination.

5. Intellectual Property Rights

JobLens Intellectual Property

All content, features, and functionality of JobLens (including but not limited to software, design, text, graphics, logos, and interfaces) are owned by JobLens, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

User Content License

By uploading content to JobLens (videos, images, notes, estimates), you grant JobLens a worldwide, non-exclusive, royalty-free license to use, display, and process your content to provide and improve the Service. You retain ownership of your content and may delete it at any time.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use JobLens for your personal business purposes only. You may not sublicense, sell, rent, or lease the Service to others.

6. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • JobLens is provided "as is" and "as available" without warranties of any kind
  • We will not be liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim arising from or relating to these Terms or the Service is limited to the amount you paid for the Service in the 12 months preceding the claim
  • These limitations apply regardless of the cause of action (contract, tort, strict liability, or otherwise)

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

7. Indemnification

You agree to indemnify and hold harmless JobLens, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your violation of applicable laws or regulations
  • Your infringement of third-party intellectual property rights
  • Content you upload or share through the Service
  • Your violation of any third-party's rights

8. Disclaimer of Warranties

DISCLAIMER: JOBLENS IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Any defects in the Service will be corrected
  • The Service is free from viruses or malicious code
  • Your use of the Service will meet your expectations or requirements
  • Estimates generated are accurate or guaranteed
  • Your data will be completely secure or protected

9. Payment Terms

Subscription Plans

JobLens offers various subscription plans with different pricing and features. You will be clearly informed of all costs before finalizing your purchase.

Billing

  • Subscription charges will be billed at the interval you select (monthly or annual)
  • We accept major credit cards and other payment methods
  • Payment information is processed securely through Stripe
  • We do not store full credit card information on our servers

Billing Disputes

If you dispute a charge, contact our billing team at [email protected] within 30 days of the charge date.

10. Cancellation and Refunds

Cancellation

You can cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period.

Refund Policy

  • Monthly Plans: No refunds for partial months. Upon cancellation, access ends at the end of the current billing period.
  • Annual Plans: We offer a 14-day money-back guarantee for annual plans. After 14 days, no refunds are provided.
  • Exceptional Circumstances: We may provide refunds or credits at our sole discretion for exceptional circumstances.

11. Data Ownership and Rights

Your Data

You retain all rights and ownership of your data (estimates, videos, images, customer information, notes, etc.). We do not claim ownership of your content.

Data Access and Export

  • You can access your data at any time through your account dashboard
  • You can export your data in standard formats
  • You can download your videos and images

Data Deletion Upon Cancellation

When you cancel your subscription, your account will be deactivated. You will have 30 days to export or download your data. After 30 days, your data will be permanently deleted from our systems. We recommend backing up important data before cancellation.

12. Third-Party Services

JobLens integrates with and relies on third-party services including:

DigitalOcean — Cloud hosting and storage
Stripe — Payment processing
Sentry — Error tracking and monitoring
Email Services — Transactional emails

These services are governed by their own terms and privacy policies. We are not responsible for their practices, policies, or availability. Changes to these services may affect JobLens functionality.

13. SMS and Messaging Services

By using JobLens and submitting a form or request that requires SMS delivery, you consent to receive transactional text messages related to moving estimates, inventory uploads, account notifications, or service-related communications.

SMS messages may be sent by JobLens on behalf of a moving company using the JobLens platform. Message frequency varies based on user interaction. Message and data rates may apply.

You may opt out of SMS communications at any time by replying STOP. For assistance, reply HELP or contact us at [email protected].

JobLens does not send promotional or marketing SMS messages without explicit consent.

14. Changes to Terms and Service

Term Updates

We may update these Terms at any time. We will notify you of material changes by email or by posting the updated Terms on our website. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.

Service Changes

We may modify, suspend, or discontinue the Service or features at any time. We will provide reasonable notice of significant changes. During the beta phase, changes may occur frequently.

15. Termination

User Termination

You can terminate your account at any time by contacting support or through your account settings.

Our Termination Rights

We may terminate or suspend your account immediately without notice if:

  • You violate these Terms or applicable laws
  • You engage in illegal or harmful activity
  • You violate another user's rights
  • We determine that your account poses a risk to the Service or other users
  • You fail to pay your subscription fees

Effect of Termination

Upon termination, your access to the Service will be immediately revoked. You will have 30 days to export your data. After that, your data will be permanently deleted. We will not be liable for any losses resulting from termination.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. You agree to submit to the exclusive jurisdiction of the courts located in the United States.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JobLens regarding your use of the Service. These Terms supersede all prior or contemporaneous agreements, understandings, and communications.
